Terms of services
This Acceptable Use Policy constitutes an Agreement between Telavir, Inc. ("Telavir") and it's account holders ("Customers") and System Users. This Agreement applies to all Telavir Customers and all users of the Telavir network system, including dialup account holders, FTP access account holders and all users accessing any World Wide Web server hosted on Telavir network computers, servers and related systems ("System Users"). This Agreement represents the complete agreement and understanding between Telavir and its Customers and System Users and supersedes any other written or oral agreement. Upon notice published on-line via Telavir's website, (http://www.telavir.com) Telavir may modify the terms and conditions of this Agreement. Telavir reserves the right to discontinue or change services offered.

USE OF YOUR ACCOUNT CONSTITUTES YOUR APPROVAL AND ACCEPTANCE OF THIS AGREEMENT. ACCEPTANCE OF THIS AGREEMENT IS A CONDITION TO USE OF THE TELAVIR NETWORK SYSTEM. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU ARE NOT PERMITTED TO USE THE TELAVIR NETWORK SYSTEM. IF YOU ARE AN ACCOUNT CUSTOMER, PLEASE NOTIFY OUR BILLING DEPARTMENT SO WE CAN INITIATE CLOSURE OF YOUR ACCESS ACCOUNT.

Terms and Conditions and Acceptable Use

1. Limitation of Warranty
Telavir makes no warranties of any kind, whether express or implied, for the service it is providing. Telavir also disclaims any warranty of merchantability or fitness for a particular purpose. Telavir will not be responsible for damages suffered by any Customer, including, without limitation, incidental or consequential damages or lost profits. This includes loss of data resulting from delays, non-deliveries, misdeliveries, system failures or service interruptions caused by any source whatsoever, including Telavir's own negligence, subscriber's errors or omissions, or due to the fault of third parties. Customers understand and agree that Telavir undertakes no obligation to maintain, protect or safeguard Customer's data stored on any Telavir equipment and Customer agrees to accept responsibility for maintaining backup copies of all such data. Customer agrees to upload and store data to Telavir equipment at Customer's own risk and Customer expressly assumes such risk.

2. Compliance with Law and Intellectual Property Rights
Customers and System Users agree that all services provided by Telavir will be used only for proper legal purposes and in a lawful manner. Transmission or publication of any information, data or material in violation of any U.S., State or international law or regulation is strictly prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret law or any other law, as well as threatening, offensive, harassing, obscene or pornographic material or content. Customers and System Users warrant that any data uploaded for publication on Telavir's web servers does not violate or infringe any copyright, trademark, patent, statutory common law or proprietary interest of others or contain anything obscene or libelous.

3. Removal and Destruction of Illegal or Offensive Data
Customers and System Users agree that Telavir shall have the absolute right to remove any and all materials which, in the sole and unrestricted discretion of Telavir, violate law or fail to conform with this Agreement and the acceptable uses described herein. Such materials may be removed and destroyed at any time, without prior notice.

4. Indemnity
Customers and System Users agree to defend, hold harmless and expeditiously indemnify Telavir from any liability, claim, loss, damage or expense arising out of the Customer's or System User's breach or violation of any term, condition or covenant contained in this Agreement or resulting from the use of any Telavir system, network or service.

5. Use of Network Access
. Telavir access and Web server accounts cannot be transferred or used by anyone other than the Telavir Customers or authorized System Users. Customers and System Users may not sell, lease, rent or assign an Internet connection or parts of the connection to any party without the express, prior written approval of Telavir. Use of Network bandwidth is expected to be reasonable and moderate. Telavir reserves the right to impose additional charges for use of Network bandwidth in excess of reasonable or allocated amounts. Customer will receive advanced notice of Telavir's intent to impose any such charges.

6. Account Cancellation
. Telavir reserves the right to cancel service for any reason without prior notice. In the event of cancellation, unused fees for the current month will not be refunded or pro-rated. Customers must notify Telavir prior to the end of their current billing period to avoid further charges. Notification will be accepted via email, fax, telephone call, or letter. Confirmation of cancellation must be received by customer for cancellation to be effective. Telavir is not responsible for unconfirmed cancellations and will not refund charges for unconfirmed cancellations. Customers canceling service within the money back guarantee period (within 30 days of initial signup) will have their monthly service fee fully refunded; the set-up fee is not refundable. Customers who cancel a pre-paid account plan (3 months, 6 months, 1 year plans) after the first 30 days of service will not receive a refund of any unused fees.

7. Agreements with Minors
Telavir requires that its agreements be made with a person who is qualified to contract. As such, Customers must be over the age of eighteen (18) years. Otherwise, a parent or guardian must accept this agreement and assume responsibility for payment of Telavir services and for Customer's compliance with this Agreement.

8. Disruption of Network Services, Excessive Use
Customers and System Users shall ensure that use of Telavir's network services shall not disrupt Telavir, its associated networks or equipment forming part of Telavir's or the internet's systems. Customers and System Users shall not transmit any communication where the meaning of the message, or its transmission or distribution, would violate any applicable law or regulation or would likely be offensive to the recipient thereof. No message may be mass distributed, "broadcast," or otherwise sent on an intrusive basis to any Telavir user or to any directly or indirectly attached network. Use of Telavir's Internet connection in a manner that is disruptive, damaging, unlawful, offensive, or intrusive as determined by Telavir shall be considered a breach of this Agreement and may result in cancellation of service. It is not acceptable to use Telavir's services and facilities to interfere with or disrupt other network users, services or equipment. Such interference or disruption includes, but is not limited to: - improper, harassing or offensive distribution of unsolicited advertising, - excessive newsgroup cross-posting, - transmissions of any type or quantity that causes disruption of service to others, - propagation of computer worms or viruses, - use of the network to make unauthorized entry to other computer networks, information or communications devices or resources, - sustained, excessive use of Telavir's access service, equipment or network connection without prior arrangement with Telavir.

9. Automated Software and Connections
The installation, compiling, use, or implementation of any of the following is prohibited without express permission: Robots, Bots, Mail Bombs, Syn Bombs or Attacks, Spamming of any kind, etc. Any process that causes excessive use of system resources to the point where other users may be affected is strictly prohibited. Software may not be installed on or compiled on any Telavir server without prior explicit permission. The use of any unattended connection software is prohibited without prior permission. All Telavir access accounts are for the use of human beings and require that a human being be present to initiate and monitor connections. Telavir has a 15 minute inactivity timeout. The use of any program to defeat this timeout is strictly prohibited. Any violation may result in immediate termination of service.

Information Collected and How It's Used

Your IP Address
An IP (Internet Protocol) address is automatically assigned to your computer every time you establish a connection via one of our modems onto the Internet. Telavir Internet uses your IP address to help diagnose problems with our modems, servers and routing equipment and to administer our website. The IP address that you use links your computer to an identifiable IP address which allows us to trace your personal information if required either to investigate abuse of our Acceptable Use Policy or when required by law enforcement agencies.

Cookies
In computer language a cookie is used to store data on your computer's hard drive. We never use cookies to capture or contain personal information from your computer. The only personal information Telavir Internet has is what you give to us.

This policy does not cover the use of cookies by any content partner or advertiser who may be on the Telavir Internet website. Telavir Internet uses content partners to provide information and services to our members and these content partners may use cookies. While Telavir Internet has control over cookies placed on the parts of our website resident on the Telavir server, our content providers and advertisers may collect and deliver cookies received with certain services or banner ads, and we do not have access to their information.

Your Account
When establishing an account with Telavir Internet you will be asked for various pieces of personal information. We also ask you to provide us some demographics information. Providing such information is optional, however, the more we know about you the better we can provide the products and services you want most, and you can receive the full benefits of our service.

We use your customer contact information to respond to your email requests and to reach you if we need additional information to complete your product request. Any financial information collected is used only for billing products and services you purchase at Telavir Internet. We may also contact you about promotional or upcoming events, or to take part in on-line focus groups or surveys. You may opt-out of these mailings as outlined below.

You control all your personal account information and you can update it at any time. You may contact our customer service department to update, change or remove your information.

The Telavir Internet website includes links to independent, third party websites. Telavir Internet is not responsible for the privacy practices or the content of such websites.

Additional Information Collected
When you make a purchase at Telavir Internet you will be asked to supply your name, address, and credit card information. This information will be stored and used to fill your order. If necessary, we may use this information to reach you if we need additional information to complete your order. Any personal correspondence you send to us, including email and letters, as well as correspondence from other customers or third parties about your activities or postings pertaining to Telavir Internet, and all entries made by you onto our site may be collected and stored. Any notes, ideas, suggestions, or other material submitted by guests becomes the property of Telavir Internet.

Telavir Internet may run contests where we ask guests for contact information such as email or physical addresses. We use contact data from our contests to send guests information about Telavir Internet, as well as promotional material from some of our partners. You may opt-out of receiving future mailings as outlined below.

Unsupervised Children
Children 17 and under are not eligible to use Telavir Internet services without the participation and supervision of a legal parent or guardian. Telavir Internet is not a site meant for children, and we do not provide privacy measures designed to protect children when using the Internet unsupervised.

Expunging Your Information From Our Records
You may email our customer service department or use one of the alternate contact methods listed below to remove your contact information from our database provided we have cancelled your account more than 1 year ago and have a zero balance on your account. Please note, however, that information is never completely removed from our history and disaster recovery archives. We also need to retain sale information for tax records.

Disclosure of Information to Third Parties

Personal Information
Telavir Internet defines personal information as your name, email address, mailing address, method of payment, and any other information that identifies you.

Telavir Internet, our suppliers and shippers use your personal information to process and ship your orders. Telavir Internet does not sell, trade, rent, or release your personal information to third parties. If we were to ever do so, you will have the opportunity to opt-out beforehand.

Transactional Information
Telavir Internet transactional information such as traffic patterns, sales, aggregate data regarding general surfing patterns, and other site information may be shared with vendors and other reputable third parties. This data will never contain any identifiable personal information of Telavir Internet members. For example, we might share statistics on how many customers purchased a specific product, but we will not specifically disclose who purchased the product.

Credit Card Security
Telavir Internet protects such personal information as your name, address, and credit card number by transferring it over a Secure Socket Layer (SSL) line. This protocol ensures your information is encrypted and cannot be read by others as it travels over the Internet. The secure mode begins as soon as you initiate your order. You should see a locked padlock icon at the bottom of your browser window to indicate you are on a Secure Socket Layer Line. You can also verify you are in secure mode by looking at the URL window in your browser. When accessing a secure server, the first characters of the site address will change from "http" to "https."

After we receive the data at Telavir Internet, it is stored on a secure server and steps are taken to ensure that your information cannot be accessed from outside the company. The Telavir Internet employees who process your order are the only people with access to your personal information. All Telavir Internet employees sign a privacy/security policy agreement, which provides legal confidentiality protections for all Telavir Internet guests. Any violation of this policy results in disciplinary action, including possible termination, criminal prosecution, and civil action.
